Doctor's antitrust claim loses on appeal

A federal appeals court has ruled that an anesthesiologist's five-year-old antitrust lawsuit against the Lafayette hospitals should not proceed. Dr. Carolyn Kochert filed the federal lawsuit in May 2001 against Greater Lafayette Health Services and Anesthesiology Associates. GLHS, the corporation that owns Home Hospital and St. Elizabeth Medical Center, had decided to grant an exclusive contract for anesthesia services to Anesthesiology Associates. The suit claimed the contract left Kochert and seven other doctors with Lafayette Anesthesiologists LLC, the only competing anesthesiology group in the area, without a place to practice. Tuesday's decision by a three-judge panel of the U.S. Seventh Circuit Court of Appeals in Chicago affirms a decision by U.S. District Court Judge Allen Sharp granting summary judgment to the defendants....

FDA CLEARS SEASONAL FLU VACCINES

Vaccines that protect against three strains of seasonal influenza considered most likely to strike the Northern hemisphere this winter have received federal approval. The Food and Drug Administration said Wednesday that four manufacturers licensed to sell their vaccines in the United States should have 100 million doses available for the 2006-2007 flu season. Barring any changes, that record number would end years of flu shot shortages and production delays. The seasonal formulation includes one strain used in last year's vaccines and two new strains, the FDA said. The vaccines do not protect against bird flu, which is caused by different strains of the virus. Scientists are developing vaccines that could protect against avian influenza. Since different seasonal influenza strains crop up each year, experts tinker with the formulation to protect against those strains thought most likely to infect people in the upcoming flu season....

USF Rebuilding Anesthesiology Program After Wake-Up Call

TAMPA - The University of South Florida, its anesthesiology program facing a loss of accreditation, plans to build a new program from scratch in time to pass the review by July 2008. The goal is to shed criticism and build a new program, College of Medicine Dean Stephen Klasko said. Problems cited have included a shortage of experienced faculty and little supervision of residents in training. "We are going to be a blank sheet of paper," Klasko said. "The new residency program will be reviewed with no history, no baggage. … If we can't have an excellent anesthesiology program, we won't have one." The decision was made Monday after an accrediting agency told the school to choose whether it will dispute the recommendation to drop its accreditation....
